Tooni Terms of Service

1. Who we are

These Terms are a legal agreement between you and us, and set out the rights, obligations and responsibilities of both sides.

2. Eligibility and your account

• You must be at least 13 years old, or the minimum age required in your country to consent to the processing of your personal data, whichever is higher.
• You may create an account with an email address and password, or sign in with Apple, Google or Kakao.
• You may be signed in on up to two devices at a time. Signing in on a third device requires signing out of one.
• You are responsible for keeping your credentials secure and for activity under your account.
• You may delete your account at any time from within the App (Settings ▸ Delete account). Deletion is permanent (see §13).

3. The service

Tooni is a drawing application with AI assistance. It includes:

• Drawing tools — brushes, layers, selection, text, speech balloons and export. These are free on every plan.
• AI generation — creating character images, poses, assets, backgrounds and panel images from your prompts, sketches or reference images. Generation runs through our servers using third-party AI providers.
• AI assistance — dialogue polishing and pose suggestions.
• On-device features — handwriting recognition runs on your device; your handwriting does not leave the device for this purpose.

We may add, change or remove features. If a change materially reduces a paid feature you are currently paying for, we will give notice in the App before it takes effect.

4. Plans

What counts as one AI generation — one successfully produced image (character, pose, asset, background, panel). Dialogue polishing, pose suggestions, background removal, handwriting recognition and exporting do not count, and failed generations are not counted.

Granted credits are issued once per 30-day cycle and expire at the end of that cycle. The cycle is counted from your account anchor date, not from a calendar month: the sign-up date for Free accounts, and the subscription start date for Tooni Pro. Unused granted credits do not carry over. Credits you purchase separately are outside this cycle and stay valid for one year from purchase.

5. Free trial

New accounts receive a 2-day free trial with 300 AI credits included. The trial:

• is granted by us at the account level, not through an App Store introductory offer;
• gives you 300 AI credits rather than unlocking the whole Pro plan, which is about 30 images at standard quality; any credits left over expire when the trial ends;
• is available once per account and once per device, to prevent the trial from being repeated by creating new accounts;
• starts when you first use AI generation, not when you sign up, so that a trial is not consumed by simply installing the App;
• requires no payment method, and ends without any charge — you return to the Free plan unless you subscribe.

6. Subscription, billing and cancellation

Tooni Pro is sold through two channels. Whichever you use, the entitlement applies to the same account — but who bills, cancels and refunds you differs by channel.

(1) If you subscribe in the App (Apple App Store)

• Tooni Pro is an auto-renewing subscription, sold on a monthly or annual term.
• Prices are shown in the App in your local currency as provided by the App Store, and are charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
• You manage and cancel the subscription in your Apple Account settings (Settings ▸ your name ▸ Subscriptions, or apps.apple.com/account/subscriptions). We cannot cancel an App Store subscription on your behalf.
• Refunds are handled by Apple under Apple's policies.

(2) If you subscribe on the web

• We sell this directly, and charge the card you register in Korean won through our Korean payment provider (NICEPAY).
• Both the monthly and the annual term renew automatically. Unless you cancel, the same card is charged at the end of each term for the next one.
• You cancel on the web billing page. Cancelling stops future charges; you keep access until the end of the period you already paid for.
• Refunds are handled by us under the Act on Consumer Protection in Electronic Commerce of the Republic of Korea and related law: a full refund within 7 days of payment if you have not used any paid feature covered by that payment, and otherwise a pro-rata refund of the remaining period after deducting the portion already used.
• To request a refund, email robin.lee@twostepsahead.co.kr with the payment date and the product name.

(3) Applies to both channels

• Cancelling stops future renewals. You keep Tooni Pro until the end of the period you already paid for.
• Deleting your Tooni account does not cancel an App Store subscription. Cancel it with Apple first, or you will continue to be charged.

7. Your content

You keep ownership of everything you draw, write, upload and generate in Tooni ("Your Content").

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce and transmit Your Content solely to operate the Service for you — for example to save your projects, generate images you request, and deliver them back to your devices. This licence ends when you delete the content or your account, except for copies retained in backups for the period described in the Privacy Policy.

We do not use Your Content to train or retrain AI models.

8. AI output — what we do and do not promise

Please read this section carefully; it is the most commonly misunderstood part of an AI product.

• AI output is generated from statistical models. Similar prompts by different users can produce similar results, and we do not promise that any output is unique.
• We do not warrant that AI output is free of third-party rights, and we do not indemnify you against claims arising from your use of it. You are responsible for checking that what you publish does not infringe anyone's rights.
• A Tooni Pro subscription grants you a licence to use the Service commercially. It is not a guarantee that you own, or can register copyright in, the output. Several jurisdictions — including the United States — do not recognise copyright in works generated without sufficient human authorship. Whether any particular output is protectable depends on the law of your country and on how much of the work is yours.
• Output may be inaccurate, unexpected or unsuitable. Review it before use.

9. Watermark

Exports made on the Free plan carry a visible "Made with Tooni" mark. The mark identifies non-commercial output and cannot be removed on the Free plan. Removing, obscuring or circumventing it without an active Tooni Pro subscription is a breach of these Terms.

10. Acceptable use

You agree not to use Tooni to create, store or distribute content that:

• is unlawful, or infringes intellectual property, privacy or publicity rights;
• sexually exploits or depicts minors, in any form;
• harasses, defames, or incites violence or hatred against a person or group;
• impersonates a real person in a misleading way, or is presented as a genuine record when it is not.

You also agree not to: reverse engineer or attempt to extract our models or prompts; access the Service by automated means outside the App; circumvent usage limits, the watermark or plan gates; or resell or redistribute access to the Service.

11. Suspension and termination

We may suspend or terminate access if you materially breach these Terms, or where required by law. Where practicable we will tell you why and give you an opportunity to respond. If we terminate your account for reasons other than your breach, we will refund the unused portion of a prepaid term where the law requires it.

12. Availability

We work to keep Tooni available but do not guarantee uninterrupted service. Maintenance, third-party AI provider outages, App Store issues and force majeure events may interrupt it.

13. Deleting your account

You can delete your account in the App (Settings ▸ Delete account). Deletion:

• permanently removes or irreversibly anonymises your account and personal data (see the Privacy Policy);
• cannot be undone — your drawings, characters and saved assets are lost;
• does not cancel an App Store subscription. Cancel that with Apple first.

14. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided "as is" and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer in Korea, Japan, the United States, the EU or the UK, you keep all mandatory rights your local law gives you.

15. Changes to these Terms

We may update these Terms. We will post the updated version in the App and on our website, and where the change is material or reduces your rights we will give at least 30 days' notice before it takes effect. Continuing to use Tooni after the effective date means you accept the change.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules, and the Seoul Central District Court has jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, nor of the right to bring proceedings there.
